Licensing
PLEASE NOTE that the Licensing (Scotland) Act 1976 ("the 1976 Act") will be completely repealed with effect from 1 September 2009 and replaced by the Licensing (Scotland) Act 2005 ("the 2005 Act").
During the transition period of 1st February 2008 and 1st September 2009 any one considering applying for a licence should read our guidance pages on the 2005 Act (link) as it will be necessary to also submit an application under the new Act to ensure continuity of trading. A licence granted under the 2005 Act will come into effect at 5am on 1st September 2009.
Any licence granted under the 1976 Act will only be valid until 5am on 1st September 2009. This means that licensees, wishing to continue to trade after that date, will need a premises licence issued under the 2005 Act.
From 1 February 2008 to 28 February 2009 the Licensing Board may not consider applications for grant/provisional grant of a licence under the 1976 Act if an application in terms of the 2005 Act is not lodged at the same time. This decision has been taken to try and ensure that licence holders have a valid licence following the change in legislation.
After the 28th February 2009, you should check with the Licensing Administrator whether the Board will deal with 1976 Act applications as it is not required to do so.

The range of Licences available from Clackmannanshire Council is varied and the timescales for submitting your application can be vital. Failure to disclose relevant information will delay processing your application so please check you have completed all relevant details.

At the moment you can download application forms and guidance notes from this site. Completed forms and the appropriate fee should be returned by post to the address detailed on the form. We are hoping to accept electronic applications in the near future.
Licence applications fall into two categories:
- Civic and Miscellaneous Licences and Permits, granted by the Licensing Section of Administration and Legal Services through delegated powers. In addition, approval of applications can be referred to the Council's Regulatory Sub Committee.
- Liquor and Gaming Licences and Permits, granted by Clackmannanshire Council Licensing Board.
