The Duty to Promote Disability Equality
- Builds on the DDA but is not about new entitlements
- Is not necessarily about changes to buildings or adjustment for individuals
- Is about weaving equality into our culture in practical and demonstrable ways
- Takes an organisational and upfront approach
- Is a tool for tackling "institutionalised discrimination"
- The key aim is to close the gaps that can exist when the experiences of people with disabilities are compared with those of people who do not have disabilities.
The general duty under this Act requires public authorities to adopt a proactive approach, mainstreaming disability equality into all decisions and activities. The authority should have due regard to the need to promote disability equality into all decisions and activities. The general duty does not only require authorities to have due regard to disability equality when making decisions about the future. But also to take action to tackle the consequences of decisions in the past which failed to give due regard to disability equality.
The duty makes the promotion of disability equality central to the way that Clackmannanshire Council operates, improving our services to everyone and helping to mainstream disability equality.
The Council strives to eliminate discrimination by auditing all policies and procedures to ensure that they do not discriminate and by making any necessary amendments. This includes joint working with partners in the wider strategic and planning frameworks within the Clackmannanshire Community Alliance.
One of the key ways in which the Council promotes equality of opportunity is by ensuring that all employees are trained in all aspects of diversity and in achieving our responsibilities under the Disability Equality Scheme. Joint training initiatives with health and local authority partners across Forth Valley will ensure that staff have access to appropriate training. Service user involvement in training.
A local audit will address the availability of resources and equipment which may be required when customers specify a particular need for assistance or support.
An audit of building and facilities has been undertaken and adjustments made.
